MOTION NO. 14

MOTION: Councillor F. Timmons

“As there are ongoing issues with litter from Take-Away / ‘restaurants’ food outlets in Clondalkin and with the possibility of a further ‘restaurant’ on the Main Street, can SDCC issue a report on how many retaurants / fast food outlets are allowed to be established or is there any limit? Can the number be capped to exclude further encroachment into the village? What criteria (apart from paying rates) is there for a fast food outlet to operate.”

 

REPORT:

It is the Development Plan policy of the County that the provision of restaurants, takeaways, nightclubs, licensed premises and betting offices will be strictly controlled, having regard to the following, where appropriate:

• The effect of noise, general disturbance, hours of operation, litter and fumes on the amenities of nearby residents or adjoining commercial activities;

• The need to safeguard the vitality and viability of shopping areas in the County and to maintain a suitable mix of retail uses;

• Traffic considerations;

• The number/frequency of such facilities in the area and

• Satisfactory arrangements with the Council in relation to litter control.

There is no provision for a limit on  takeaways.

Takeaways are generally a separate class of use development and require planning permission.  Applications for permission are assessed in accordance with statutory provisions and the policies and objectives of the Development Plan. Approved takeaways must operate with the terms of the permission granted.  Failure to do so may result in planning enforcement
